Assembly Bill 2466A....(This one needs to be adressed..IMHO)

Also introduced was A 2466A, which seeks to drastically expand the state's ban on so-called "assault weapons" by adding pump action rifles and reduce the number of allowed features from two to zero. Additionally, the bill would give the State Police broad authority to designate additional firearms to be outlawed. Under the bill, those who wish to keep "banned" firearms lawfully possessed prior to January 1, 2007, must register them and have them tested for entry into the state's failed ballistic imaging program. Many of the guns affected by this bill are widely used in competitions and hunting.

AN ACT to amend the penal law, in relation to the possession of armor
piercing, frangible or devastator ammunition

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

1 Section 1. Subdivision 18 of section 265.00 of the penal law, as added
2 by chapter 646 of the laws of 1986, is amended to read as follows:
3 18. "Armor piercing ammunition" means any ammunition {capable of being
4 used in pistols or revolvers} containing a projectile or projectile
5 core{, or a projectile or projectile core for use in such ammunition,
6 that is} constructed entirely (excluding the presence of traces of other
7 substances) from one or a combination of any of the following: tungsten
8 alloys, steel, iron, brass, bronze, beryllium copper, {or} uranium,
9 CERAMICS, OR POLYMER PLASTICS AND CAPABLE OF BEING USED IN PISTOLS AND
10 REVOLVERS.
11 S 2. Section 265.00 of the penal law is amended by adding two new
12 subdivisions 24 and 25 to read as follows:
13 24. "FRANGIBLE AMMUNITION" MEANS ANY AMMUNITION WITH A PROJECTILE OR
14 PROJECTILE CORE COMPOSED OF HYBRID MATERIALS, EITHER PRESSED TOGETHER AT
15 HIGH PRESSURE OR GLUED TOGETHER WITH ADHESIVES, WHICH IS CAPABLE OF
16 BEING USED IN PISTOLS OR REVOLVERS AND IS DESIGNED TO FRACTURE OR DISIN-
17 TEGRATE UPON IMPACT.
18 25. "DEVASTATOR AMMUNITION" MEANS ANY AMMUNITION WITH A PROJECTILE OR
19 PROJECTILE CORE WHICH IS CAPABLE OF BEING USED IN PISTOLS OR REVOLVERS
20 AND DESIGNED TO EXPLODE OR DETONATE UPON IMPACT.
21 S 3. Subdivisions 7 and 8 of section 265.01 of the penal law, subdivi-
22 sion 7 as added by chapter 807 of the laws of 1981 and subdivision 8 as

8 chapter 189 of the laws of 2000, is amended and two new subdivisions 9
9 and 10 are added to read as follows:
10 (8) Such person possesses a large capacity ammunition feeding
11 device{.}; OR
12 (9) SUCH PERSON KNOWINGLY POSSESSES ANY DEVASTATOR AMMUNITION WITH THE
13 INTENT TO USE THE SAME UNLAWFULLY AGAINST ANOTHER PERSON OR HIS OR HER
14 PROPERTY; OR
15 (10) SUCH PERSON KNOWINGLY POSSESSES ANY ARMOR PIERCING AMMUNITION OR
16 FRANGIBLE AMMUNITION WITH INTENT TO USE THE SAME UNLAWFULLY AGAINST
17 ANOTHER.
18 S 5. This act shall take effect on the first of November next succeed-
19 ing the date on which it shall have become a law.

9 TIVE DATE OF THIS SECTION WHICH DOES NOT CONTAIN A CHILDPROOFING DEVICE
10 OR MECHANISM INCORPORATED INTO THE DESIGN OF SUCH PISTOL OR REVOLVER TO
11 EFFECTIVELY PRECLUDE AN AVERAGE FIVE YEAR OLD CHILD FROM OPERATING THE
12 PISTOL OR REVOLVER. SUCH DEVICES OR MECHANISMS SHALL INCLUDE, BUT NOT BE
13 LIMITED TO: THE CAPACITY TO ADJUST THE TRIGGER RESISTANCE TO AT LEAST A
14 TEN POUND PULL, THE CAPACITY TO ALTER THE FIRING MECHANISM SO THAT AN
15 AVERAGE FIVE YEAR OLD CHILD`S HANDS ARE TOO SMALL TO OPERATE THE PISTOL
16 OR REVOLVER, OR THE CAPACITY TO REQUIRE A SERIES OF MULTIPLE MOTIONS IN
17 ORDER TO FIRE THE PISTOL OR REVOLVER.
18 3. THE SUPERINTENDENT OF THE STATE POLICE SHALL, IN CONSULTATION WITH
19 SUCH GUN MANUFACTURERS AS SUCH SUPERINTENDENT DEEMS APPROPRIATE, ADOPT
20 RULES AND REGULATIONS ESTABLISHING MINIMUM STANDARDS FOR CHILDPROOFING
21 DEVICES OR MECHANISMS TO ENSURE THAT SUCH CHILDPROOFING DEVICES OR MECH-
22 ANISMS ARE SAFE AND EFFECTIVE.

Assembly bill A 9280 deals withpreventing guns from being acquired by individiuals who are not the intended recipients..

Let me just say that after briefly reviewing these laws I find the majority of this legislation concerns simple comon sense matters thatunfortunately we can not take for granted. Therefore these pieces of legislation are onlyenforcing standard common sense practices. However it is obvious that there may be some pieces of the legislation unintentionallyinfringe on gunowners/gun salesmans rights.If this is the case is now our job to indentify those specific issues and raise awareness of the matter before the bills move forward towards legislation....

BTW, not to single this individual out...but statements like this are exactly why I took a great deal of my own personal time to provide the proper information concerning the proposed regs..

The statement is completely and factually wrong...it only serves to fuel an us vs them attitude that will only alienate the gun community further from the lawmakers that propose such bills.

We need to work with the lawmaking community...not against them... posting misleading ordownright incorrect information on public forums is not the best means to accomplish that goal....IMHO

The way this is written, a Remington 1100 with fully rifled barrel would be Illegal. It would be a semi-automatic rifle, firing a .50 projectile. Don't know if the issue would be pushed, but that is what it states.

And on another side note, California did away with the .50BMG also. So what has one manufactuer done? Barret has come up with a cartridge based on the BMG necked down to .416. Almost an identical powered weapon, but perfectly legal. So, did the bill really change anything? And what is their concer over a 50 BMG anyways? When was the last time one was used by a gang banger in a drive by? Or the last time a crook held up a gas station with one? How many crimes were commited at all, ever? The answer is none.

Thanks for posting the bills. Glad the truth of the matter was brought to light.

He methodically drove the bulldozer through the town of Granby, damaging or leveling 13 buildings before taking his own life. Stewart of Mesa, Arizona, a convicted felon, was charged with felony possession of firearms for being in possession of Maadi-Griffin 50 caliber "kit guns" he was selling from his home, along with other firearms alleged to be in his possession. Stewart has become a folk hero among hard-line gun advocates and 50 caliber enthusiasts. He was distinguished, among other things, by his assertion that convicted felons have the right to possess firearms: "I don't care if he's a mass murderer, he killed 50,000 people. [*]In April of 2000, convicted felon Wayne Frank Barbuto of Salt Lake City, Utah, was charged with attempting to sell two 50 caliber sniper rifles to undercover federal agents. The government believes Barbuto manufactured the guns himself. During a search of Barbuto's home, Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) agents discovered more than 32 firearms and thousands of rounds of ammunition. [*]According to the General Accounting Office (GAO), 50 caliber sniper rifles have been found in the armories of drug dealers in California, Missouri, and Indiana. A federal investigation in 1999 was "targeting the movement of .50 caliber semi-automatic rifles from the United States to Mexico for use by drug cartels." [*]On March 19, 1998, following an undercover investigation, federal law enforcement officers arrested three members of a radical Michigan group known as the North American Militia. The men were charged with plotting to bomb federal office buildings, destroy highways, utilities, and public roads, and assassinate the state's governor, senior U.S. Senator, federal judges, and other federal officials. All three were ultimately convicted. A 50 caliber sniper rifle was among the weapons found in their possession. ("Prosecutor: Hate Was Motive Behind Plot," The Associated Press, November 18, 1998)

[*]Wisconsin father and son James and Theodore Oswald were sentenced in 1995 to multiple life terms for armed robbery and the murder of a Waukesha police captain. The two had "a small armory of sophisticated and expensive weapons, including two custom-made .50-caliber rifles powerful enough to assault an armored car—which the two were considering doing," according to the Waukesha county sheriff. [*]In the summer of 1995, Canadian officials in British Columbia found a Barrett 50 caliber sniper rifle, 500 rounds of ammunition, and enough explosives to fill a five-ton truck at a remote site. It is believed that members of a Texas militia group planned to set up a training camp at the site. Although at least one convicted felon was identified as a suspect, the investigation was dropped due to difficulties in prosecuting across international borders. The incident prompted one Texas Constitutional Militia official to observe, "We are not all raving maniacs. I'd kind of like to keep our lunatics on our side of the border." [*]On April 28, 1995, Albert Petrosky walked into an Albertson's grocery store in suburban Denver, Colorado, and gunned down his estranged wife and the store manager. Armed with an L.A.R. Grizzly 50 caliber sniper rifle, an SKS Chinese semiautomatic assault rifle, a .32 revolver, and a 9mm semiautomatic pistol, Petrosky then walked out into the shopping center parking lot, where he exchanged fire with a federal IRS agent and killed Sgt. Timothy Mossbrucker of the Jefferson County Sheriff's Department. Petrosky, who was known to his friends as "50-cal Al," fired all four weapons, including the 50 caliber rifle, during his murderous rampage. [*]Branch Davidian cult members at a compound in Waco, Texas, fired 50 caliber sniper rifles at federal ATF agents during their initial gun battle on February 28, 1993. The weapons' ability to penetrate tactical vehicles prompted the agency to request military armored vehicles to give agents adequate protection from the 50 caliber rifles and other more powerful weapons the Branch Davidians might have had. [*]On February 27, 1992, a Wells Fargo armored delivery truck was attacked in a "military style operation" in Chamblee, Georgia, by several men using a smoke grenade and a Barrett 50 caliber sniper rifle. Two employees were wounded. ("Two Armored Truck Guards Shot," The Atlanta Journal Constitution, February 27, 1992)

[*]In 1989, two members of a church in Gardner, Montana, who were part of what ATF has described as a "doomsday religious cult," were arrested and charged with federal firearms violations. The two suspects had purchased hundreds of firearms, including ten 50 caliber semiautomatic rifles and thousands of rounds of ammunition, using false identification.
