This will be my 2nd season of hunting
2 things that were mentioned here that I have questions on..

Does anyone have a good drawn up document that I could present to a prospective landowner of property I would like to hunt that alleviates him of liability?

I don't understand why there is a problem with Sunday Hunting. I have limited vacation time and what time I do take is usually with my family. One daughter hunts with me but the wife and older daughter will not. This leaves me with only Saturdays for hunting . I sure would like to be able to double my hunting time. I just don't understand why no Sunday hunting

Neither do I DannyD. I live in Putnam County and when the law was first passed there were people already working to get it on the ballot and voted out. One fellow told me that during the fall he would like to take walks in the woods with his grandchildren without the fear of being shot and Sunday was the only day of the week he could do that. I say that's a bunch of bull. You'd be hard pressed to find any of those people out in the woods on Sunday or any other day with their kids or grandkids because they don't like hunting and will do or say whatever they can to stamp it out. We had 2 seasons of Sunday hunting here in Putnam County before it was voted out. I don't own hunting property here but if I did and I still wanted to bowhunt on Sunday I'd probably do it. By the way, I think it still should be allowed in WMA's no matter what that county's status is on Sunday hunting.

The matter of Sunday hunting in WV is currently waiting to be heard by the WV Supreme Court. Believe it or not, the ACLU is representing the side of hunters( a hunt club actually). The action is being brought on two fronts as being unconstitutional. First they are saying that the county can not superceede state law with reguards to private landowner rights * hunting on private land only), Secondly, they are arguing that an otherwise legal activity can not be infringed because of the day of the week.

The case is Hartly Hill Hunt Club, et al. v. Richie County Commission. Jason Huber is the cooperating attourney.

It may take afew yearsto find out the courts opinion as we all know how slowly the wheels of justice turn.

Thank god my camp is in Wetzal Co. one of the few where sunday hunting is still allowed.Seems to me I should be able to do on sunday what I do ever other day of the week, especially on my own land.

ive always been kinda torn between the sides on the sunday hunting thing. Although i did vote FOR sunday hunting in the last election where it was on the ballot. It would be nice to have another day to hunt, and i know alot of guys who work so many days that sunday is the only time they can get out. On the other hand we hunt Mon-Saturday, and just like people the animals need a break from stress. I like to give them one day to rest up and take it easy before i chase them around again. Hope i didnt come off like a useless anti, but i can see both sides of reasoning on the dispute.

...it wouldn't be worth the paper it's written on.... I had a friend who wanted to open his 100 ac up to 4 wh/dirt bike track... went to see a lawyer about liability.. was told that if he KNEW they were doing DANGEROUS activities on his property, HE WAS LIABLE, regardless of waivers signed. THAT'S a fact...... as for Sunday hunting...I, personally won't do it...ever...that's due to what I feel is meant by "keeping the Sabbath Holy"... ONLY because of it's taking of a life, and shedding of blood. you believe whatever you wanna believe, it's a personal issue. As for Sunday sports, I watch 'em, like everyone else...love football & Nascar... I don't wanna forget that there's some whos' beliefs say that Sat. is the Holy Day.. never disrespect them( and it's been legal on THEIR Holy day for ever)... tough one to swallow if you're in their shoes.
As for hunters going to bed with the ACLU on ANY issue,that's scarier than any Sun hunting issue. Hunting WAS an american tradition country-wide, it's taken a back-seat to video games/MTV/and the suburban mentality. Does anyone here know of ANYONE who's moved into your hunting area,from the suburbsand openly ALLOWED hunting? ..not in Hardy...or Berkeley... or Morgan...or Hampshire... or ANY area that I have/do hunt...

I understand that there are those who are against hunting on Sunday (and some on Saturday)for religious beliefs.If they decide not to hunt on those days I would never tell them that they are wrong not to and I do not believe they are wrong not to.
I would also believe thatit is inappropriate to not allow me to hunt on those days because of their religious beliefs.

That is great. Believe what you want and I respect that. Your personal beliefs aresacred to you and that should never be questioned.On the flip side of that coin however, what gives anyone the right to tell me what I can do on my private land just becuase of the day of the week when any other day it is a perfectly legal activity? I find a total lack of respect for me, the private landowner,in that.Issues of God, personal beliefs related to any church,and the law should never ever be considered together for any reason, hence the seperation of church and state.

Just for the record, I am an ordained minister and I SUPPORT Sunday hunting. ( after Church ofcourse...lol!)

What about Mondays and Wednesdays? Those are days of worship too???

Like many has said, it should be a personal decision. At least allow bowhunting. As far as giving the animals a break, they get it during the week when most people are working. I'm glad my county has Sunday hunting but, if it didn't, I would still go on my property regardless of the law.

when is that case going to be heard? do you know?. I think it's great that the "good guys" are getting a little mileage out of the aclu and have actually heard of cooperation between the two in several 2nd amendment issues.
