Is hunting over a bucket of water considered baiting?

Is hunting over a bucket of water considered baiting?
Besides hunting and pestering the wife, I also keep five hives of honey bees. The summers have been pretty hot and dry here in Nebraska the last few years so I have bought one of those big plastic tubs with rope handles that Walmart has been selling and I keep it filled with water for the bees so that they don' t have to fly so far to get it.
Well, the deer have taken a liking to it also and just late last week a pretty good sized rub turns up on a sapling right beside the water tub. If I set up a stand nearby, is that considered baiting in you guys' opinions? I' m going to call the game commission here in Nebraska and I' ll let you know what they say, but I was wondering what you all think.

Only your game commission can answer that question. Each state is different. I wouldn' t think it is baiting, but they may see it differently. Intent doesn' t always have to be present to be considered an illegal activity.
It' s legal to bait deer here in Oklahoma, but not migratory birds or turkeys.

The Nebraska Game commission just told me that it is not illegal, that water is not included on the baiting ban. Also, since it was put out for what could be called ' livestock' (my bees), that it is excluded regardless.
