A settlement has been reached in a lawsuit that alleged a defective tree stand and harness caused the 2002 death of an off-duty Pennsylvania state trooper who was hunting near his home in Elgin.
Terms of the settlement were sealed by the court.
The defendants were API Outdoors Inc., Outland Sports Inc. and Cabela's.
With such settlements, the defendants typically admit no wrongdoing.
The lawsuit stemmed from the Oct. 5, 2002, death of Timothy Bell, a 34-year-old trooper with the Corry barracks, who died of asphyxiation when a tree stand collapsed from underneath him and he became tangled in his safety harness.
Lawyers representing the defendants in the case could not be reached for comment.
Widow Tamara Bell's lawyer, Jaime D. Jackson, of Lancaster, said he declined comment out of respect for the Bell family.
Tamara Bell filed a lawsuit in 2004 in Erie County Court that charged the tree stand lacked an adequate pin to hold the foot platform in place and keep it from collapsing. She also said the safety harness did not have a mechanism to allow a user to lower himself to the ground or hang safely in the air in the event the stand collapsed beneath him.
The case charged that API Outdoors Inc. and Outland Sports Inc. -- the companies that made the API Grand Slam Shooting Star tree stand -- and Cabela's, the company that sold it, should have known the tree stand and its harness were defective and dangerous to those who used them.
Bell said the defendants were liable for her husband's death and for the damage and loss his death brought to her and the couple's two children.
API Outdoors Inc. was a subsidiary of Outland Sports Inc., of Tallulah, La.
Had the case gone to trial, the defendants planned to argue that the death occurred the first time that Timothy Bell used the tree stand, which belonged to his father.
They said the product was not defective and claimed that Bell did not use the tree stand properly.

But take my word for it there was a substantial pay off for a reason. The real cause of death is what this case was about. I am not placing blame,just offering some knowledge,if it is chosen to be usedthatis completely up to you.

I've got an API bowhunter but of course it'sopen.
I like to have a climber when I hunt out of state or something but for the most part my preference is to hunt out of hang on stands.
I just don't like humping stands in and out every day.
Climbers are comfy. Especially for all day sits.
For what it's worth you can still get parts for API stands through Bass Pro.
They bought the parts business from them.

I use an API Grand Slam Super Star. The climbing seat bar opens for an open front if desired, and there is a combo foot/rifle rest, depending on if its positioned up or down. The stock chain covering stinks, but if you replace it with regular vinyl tubing you can get at home depot, it is very durable. Just pop out the bushings for the chain, replace the heat shrink stuff or whatever it is with vinyl tubing, and you're good to go. Very comfortable stand. And sorry, I like the harness. Lawyers can argue anything and win. Of course the harness lacks a mechanism to get you safely back in the tree. if you use it right, you shouldn't need one. There are probably some devices people use that can help you in case of a fall, but I wouldn't think they generally come with climbing stands, or fixed stands for that matter. I'm thinking thats something you'd have to get after market.

I've hunted out of an API for a lot of years, bought mine back before the company was sold. I guess probably at least 12 years. I love the way it climbs and descends. I didn't care for the seat so adapted a seat from another climber. I now own 3 climbers API, Buckshot and Equilizer. The API has the best range of trees it can be used on. It's only a pound or two more than summit or those others. I don't find it noisy except the chains inside the tubes when you walk. I shoved some foam down the tubes to quiet it. I personnally don't have a problem with the chains. You can get replacement shrink tubing for something like $10 for a set. I usually buy 2 sets at a time so I have it. Last time I had to buy it somewhere else in Alabama or Miss or somewhere like that. I'm now in my Equalizer mode so doubt the API or Buckshot will get a lot of use this year. On my API I put foam pipe insulation on the rails and taped it on with camo tabe. I padded the front part two so I could sit facing the tree if I wanted in more comfort. I like the stand.

I've been using a grand slam bowhunter for at least 10yrs. I like it and have no problems with it at all. I think it's quiet while climbing and carrying as long as you cinch it together tight. Just make sure you use the ratchet strap on the top section.

I have 4 API Grand Slam Supreme climbers with the bar enclosed front.
I actually use them nowas hang on stands and simply put steps up to them.
I also have 2 Summit Goliath climbers that I use for my climbing hunts.
The API's are very comfortable with the full padded backrest, and seat.
The API's are not as stable as the Summit's, and they don't engage the tree as well as the Summit design. I have noticed the API's have the tendency to teter on a smoother bark tree instead of biting in like a Summit does.
I agree with all the complaints about the API chains, and shrink tube. It will not last long. I now use them exclusively as hang ons and it is not a big issue now, but when I climbed a lot with them it got chewed up quick.
The API's are decent stands but there are better out there.

SUMMIT Treestands
This is my own opinion but I would prefer the Summit Viper (or other Summit stands). I have the Summit Viper stand and it's superb. Next to my bow, my Summit treestand is probably the next best investment in hunting equipment that I have ever made in my 35 plus years of hunting.
